Special Needs Trust

A Special Needs Trust (also referred to as a supplemental needs trust, self-settled special needs trust, third-party special needs trust or pooled special needs trust) allows an individual with a disability to be a beneficiary of a trust that may own unlimited accounts, real estate or mineral interests without jeopardizing eligibility for government programs and assistance.

A special needs trust is a separate document from your other Estate Planning documents.

Susan E. Johnson-Drenth was the primary author of the legislative Bill for special needs trusts in North Dakota, which became North Dakota Century Code Chapter 59-08.  Trusts for Individuals with Disabilities.
